By starting a trial, choosing a plan, or using the Service, you agree to them. If you use the Service for a company, you confirm you can accept these terms for it, and "you" means that company. ## The Service Artificial Outreach runs outbound and inbound email for businesses: it finds companies that fit, verifies addresses, drafts messages for one person at a time, sends the messages you approve from your own mailbox, answers website leads where you switch that on, and tells you when people reply. It is for business use only. ## Accounts and seats You are responsible for your account, for keeping sign-in details secure, and for everything done by the people you invite. Seats belong to your plan and share its limits. Tell us promptly at hello@artificialoutreach.com if you suspect unauthorized access. ## Free trial - Each organization can have one free trial: 14 days of the Starter plan with 30 data credits. No card is required. - When the trial ends, your workspace goes read-only. Nothing is written or sent, and nothing is deleted straight away. Choosing a plan restores it in place. - If you do not choose a plan, the workspace’s data is kept for 30 days after the trial ends, then deleted. ## Plans, billing and renewal - Plans are monthly with no contract, or annual, where you pay for ten months and get twelve. Both renew automatically until cancelled. - Prices are on our pricing page and exclude taxes, which are added where required. Payments are processed by Stripe. - Upgrades take effect immediately and are charged the prorated difference. Downgrades and cancellations take effect at the end of the billing period. - Fees are non-refundable, including for partly used periods, except where the law requires otherwise. - When a plan ends and is not renewed, the workspace goes read-only and its data is kept for 30 days, then deleted. ## Data credits and plan limits - A data credit pays for a data action: verifying an address costs one credit, revealing an address from the data provider costs one, and enriching a company costs three. Writing and sending are included. - Each plan includes a monthly number of data credits, shared by your workspace. Unused credits do not carry over to the next month. - Extra credits cost 10 cents each and have no cash value. - When your credits run out, verification and enrichment stop and the affected items are held as "out of credits"; everything else keeps working. - Plans also limit connected mailboxes, products, seats and sends per month. An extra mailbox costs $9 a month. ## Your mailbox, your domain, your outreach Messages are sent from your own mailbox and domain, in your name. You are responsible for your domain’s sending reputation. The Service checks your domain’s mail records at connect and warns you about problems, but it does not prevent you from sending. You decide who to contact and what to offer, and you are responsible for making sure your outreach is lawful. In particular you agree to: - Comply with the laws that apply to your messages and the people you contact, including anti-spam, electronic marketing and data protection laws such as CAN-SPAM, CASL, the GDPR, the UK GDPR and PECR. - Have a lawful basis to contact the people you reach, and honour unsubscribe and objection requests. - Identify yourself accurately, and include a valid postal address and anything else the law requires in your messages. - Keep your offers and product information true. - For calls, comply with telemarketing and call-recording laws, including the TCPA, do-not-call registers, calling-hour rules, and any consent needed to record or transcribe a call. The first message of any outbound sequence waits for your approval. If you switch on first replies to website leads without approval, or any other automatic sending, you are responsible for the messages sent under that setting. ## AI-drafted messages The Service drafts messages from your product information and what it finds about each company and person. You can edit a message or ask for a rewrite before it goes. Drafts can still be wrong or out of date, and you are responsible for the messages you approve and the switches you turn on. ## Acceptable use You must not use the Service to: - Send spam, deceptive, harassing or unlawful messages, or contact people who have asked not to be contacted. - Upload or send sensitive information such as patient health information, financial account numbers or government identifiers. - Get around plan limits, share accounts outside your organization, or resell the Service without our written agreement. - Probe, disrupt, reverse engineer or scrape the Service, or introduce malicious code. - Break the terms of any service you connect. We may pause sending or suspend an account to prevent harm, protect sending reputation or respond to complaints, and we will tell you why when we can. ## Connected services When you connect a mailbox or a data provider, you authorize us to use it to provide the features you turn on. Your use of those services is governed by their own terms, and they may change or limit access in ways that affect the Service. ## Your data You own the content and data you put into the Service, and you give us permission to host and process it only to provide and support the Service for you, as described in our Privacy Policy. You are responsible for having the rights to the data you upload or connect. ## Our property and feedback The Service, including its software, design and content, belongs to Artificial Outreach and its licensors. If you send us feedback, we may use it without obligation to you. ## Suspension and termination You can cancel at any time as described above. We may suspend or end your access if you materially breach these terms, fail to pay, or use the Service in a way that risks harm to others or to the Service. When access ends, scheduled messages are cancelled. ## Disclaimers and limitation of liability The Service is provided "as is". To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise uninterrupted service or any particular outreach result. To the extent the law allows, Artificial Outreach is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim. ## Indemnity You will defend and compensate Artificial Outreach for claims by third parties arising from your outreach, your content, or your breach of these terms or of the law. ## Changes, law and contact We may update these terms. We will post changes here, update the date above, and email account owners 30 days before a material change takes effect. Continuing to use the Service after that means you accept the change. These terms are governed by the laws of the jurisdiction in which Artificial Outreach is located, and its courts have exclusive jurisdiction.
